Abigail Hernandez sentenced for threats against East High; deportation hearing looms

Abigail Hernandez was sentenced to 3 years of probation Tuesday, but a far more consequential court date comes tomorrow in Batavia.

Hernandez, a former Edison Career and Technology High School student, had pleaded guilty to third-degree falsely reporting an incident, a misdemeanor.

She was examined by two court-appointed doctors who found her to be mentally competent and was sentenced according to a pre-arranged plea deal.

That probation term puts an end to her civil case; the question remains whether she'll be deported to Mexico, where she was born.

She will face an immigration hearing Wednesday at the federal detention center in Batavia.

Hernandez is not a U.S. citizen but qualified for Deferred Action for Childhood Arrivals status, according to her family. The criminal charges prompted the Department of Homeland Security to initiate deportation proceedings.

In delivering his sentence, Coun Judge denies Abigail Hernandez request to remain in the U.S.
